Writing this for LETTER TO THE EDITOR, Norma’s article dated Nov. 4, 2015 in the Courier needs to have the facts checked because the following statement by the President of the POA is incorrect, an outright lie, he is misrepresenting the original covenants. The original developers stated that, a homeowners association could be formed if the majority of people who reside in the Druid Hills want an association. The developers by no means setup a mandatory POA, in 1971 there was no association in the Druid Hills Subdivision at that time. The POA president stated in the Nov. 4, 2015 article, “Ours is a mandatory POA setup by the developer in the original 1971 covenants”, Rusterholtz.
The facts are the developers Ken Barber and Burns Moore’s “Declaration of Protective Covenants” states in paragraph 7. Homeowners Association: “A homeowners association may be formed if desired by residents in Druid Hills, and the sole qualification for membership shall be ownership of a fee or undivided fee interest in any lot in Druid Hills. “If the majority of lot owners elect to form such as association, then all members agree to become members…This never happened!!.
The DHPOA was formed without the consent, expressed desire, or recorded vote of any type, * of the then property owners of the Druid Hills, (majority of owners) as is required by the original covenants”. In1985, there was not a vote, approval, or consent, from the residents of the Druid Hills, the POA has no proof of signatures or votes to have formed such an association. To repeat, the developers of the original 1971 covenants stated the above conditions as “if the majority of lot owners elect to form such an association” they may do so. The truth is the majority of residents did not desire or want an association to be formed. I have
proof, a sworn statement in 2002 of the truth about the illegal forming of the DHPOA, by the founder and President of the DHPOA. Therefore, Rusterholtz is incorrect about their association being mandatory any time in this century.
