Donate Support Our Cause for DHHOA the Druid Hills Subdivision for life, liberty and the pursuit of happiness.  Help eliminate the DHPOA a deceptive, fraudulent group that has deceived us all.The Property Owners Association (POA) has tried to control us despite their initial formation was without a vote or consent to form an association. Our covenants that ran with the land stated’ if the majority wanted to form an association then they could do so…. They formed anyway without a single vote or consent.

Cecil Stambaugh the founder and former President of the DHPOA testified at my hearing “the       POA  had no vote but formed anyway”. He was at a disadvantage when the opposition asked him questions about exhibits he did not have before him, so he could not recall what documents were adopted since 1985 and he moved from our subdivision 18  years ago. He resigned as board member in 2000 and left our subdivision in 2002 in disgust from what the DHPOA had become, rewriting our covenants. In addition, the rewrite of our original covenants in June 29, 2001 did not have the majority vote to be in effect. Their was much conflict among homeowners in our subdivision about the passing of the 2001 Declaration of Covenants. Still the DHPOA denied to tell the truth or follow the rules about the vote.

Two wrongs do not make a right!

Big deception, the DHPOA  formation in 1985, a violation to our original covenants.  Deceiving our developers who wrote the original covenants, expected the DHPOA to have formed as to the requirements stated in the original covenants by having the majority vote, that they did not have. No record of any vote was ever filed with the Clerk and Recorder or anywhere else known.

Whereas, their Declaration of Covenants of 2001 did not have the majority vote, still they filed it on 6-29-2001. This 2nd Amendment is what they base their ‘Protective Covenants’ on, once written on their street sign. Filing 2 had the vote to opt out of any covenants in 2002 encumbered upon them, but the DHPOA denied their majority votes having any ground to be in effect.  Still demanding assessments from all in Filing 2.  When the original homeowners that voted to opt out moved the DHPOA jumped at the opportunity to collect assessments from the new owners that were unaware of the opt out.

This kind of misconduct from a ‘rouge association’ has gone on too long, that’s why I never joined the DHPOA, never paid dues. Now they have a Spurious Lien on my property, I have spent most all of my resources to fight the DHPOA. They still say they formed legally and the liens are valid, but they have nothing to back up their interest and penalties.  They base the liens on the 2016 covenants. The 2001 covenants was re-recorded a second time for the 2016 covenants. Thus the term ‘retroactive’ something made effective from something prior’. The prior is non-effective; therefore, how can the 2016 covenants be valid or in effect.

We all need to open our eyes and fight the DHPOA, they do not govern us, they have no ‘effective’ documents to back their formation or their Declaration of Covenants in 2001.

David Rusterholtz has had his attorney adopt the POA’s nine policies in 2016 that they do not follow the rules stated in those policies. In 2017 his attorney adopted new By-laws that did not get the majority vote to resend the original By-laws. Finally the spurious liens put on homeowners properties in 2018.

All of the above burden us as homeowners, three unfortunate homeowners paid their liens and two sold their properties once they had their liens released by the DHPOA. Please help us put a halt to this kind of actions the DHPOA imposes on us, not in good faith. I hate to be lied to and treated so unfairly.

Who in their right mind would want any part of the DHPOA if they knew the truth.  It is easy to believe the lie the DHPOA continues to stick by and it is easier to move as so many have done, get out of this subdivision away from the drama caused by this vicious group All they care about is the money they collect from dues. Either they steal it or force you to pay any way they can. This is not right, they are a voluntary association, you have a right to not join the DHPOA.
