PLEADINGS
Plaintiff’s attorneys had excellent pleading – POA did not exist because ‘no votes’ for their formation, their protective covenants of 2001 did not have the majority vote. ‘Respondent does not have the legal authority to file a lien against any property owner for nonpayment assessments, because POA Protective Covenants was not properly formed the lien is spurious’.
Justice, unfortunately did not prevail, no matter what anybody said or not allowed to say at the hearing for the’ PETITION TO REMOVE SPURIOUS LIEN’ and ‘AFFIDAVIT IN SUPPORT TO PETITION TO REMOVE SPURIOUS LIEN’, the judge had his mind made up, according to three plaintiff’s supporters in the courtroom!

EVIDENCE NOT PRESENTED: The original By-Laws, Votes, and Counter Document, notarized opposing POA claim to Lien reception # 707004. Letter to Rebuke Payne’s letter dishonoring my legitimate HOA reception # 69391 with the Clerk and Recorder.
In addition, the ‘Record Requests’ requesting the votes required for their Protective Covenants of 2001, was refused by the POA board.

POA ATTORNEY DENIES EVERYTHING
There has to be real documented proof of votes for their 1985 formation that was not approved or confirmed. The need to substantiate the majority vote for the 2001 Protective Covenants where errors occurred with the voting. Whereas the original By-Laws, ‘One vote per household, regardless of the number of lots owned’ demonstrates the true voting rules. (See below)

If my attorneys corrected for completion our ‘Exhibit 14-Votes’ as evidence this would of proved the votes were counted incorrectly by the POA for their Protective Covenants filed on 6-29-2001.
