People of the Druid Hills Subdivision would lose our civil rights as homeowners if suppressed by the Property Owners Association (POA). David Rusterholtz runs a rogue association with no consideration as President. Causing undue burden, turmoil, harassment governing homeowners, fighting for their rights against inappropriate treatment and hardship. WE ARE NOT A PLANNED COMMUNITY, POA has no right to use the CCIOA against homeowners for LIENS AND FORECLOSURE.

The DHHOA, is licensed as a 501 (c) 4 within the rules of government, the DHPOA is not licensed OR RECOGNIZED. The IRS has not heard of them as a business, you can check the IRS website. DHPOA collects money for dues, liens, and payment from those that are too scared to go to court , as the POA’s collection agency law firm “Altitude law” raises the amount owed immensely that the victim backs out. Do they report revenue or file anything with the IRS? NO

In opposition the Druid Hills Property Owners Association illegally formed in 1985 without a single vote verbally, or written, NOT filed on record. Violating our Declaration of Covenants that required a majority vote of residents to form properly. And in 2001 the DHPOA did not get enough votes to pass their own Covenants 2001.

NOTE: CECIL THE FOUNDER AND PRESIDENT OF POA WROTE THIS AFFIDAVIT IN 2002. BEFORE Cecil RESIGNED he LEFT OUR SUBDIVISION OF SOUND MIND. HE WAS FOUND NOT CREDIBLE AT MY COURT TRIAL ABOUT SPURIOUS LIEN IN 2019, WHERE MY PETTIFOGGER ATTORNEYS FAILED TO TELL ME HIS MIND WAS CLOUDY.

POA MISCONDUCT

David Rusterholtz’s agenda ignores the rules of proper operation by not having a majority vote from homeowners here in the Druid Hills Subdivision. Beginning in 2016 he instated his policies, by-laws, and liens, voted in by only by the POA board.

All the years they have been in operation, goods and services not rendered to the majority of homeowners yet, we are forced to pay or suffer their wrath from their COLLECTION AGENCY attorneys. As for myself I am grandfathered and never joined the POA.

Nevertheless, the DHPOA still demands dues from another Association in our Subdivision the DHHOA.

New residents of the Druid Hills are put on the POA board to support the POA. Others are self-elected constituents. This group is a voluntary association telling all residents that they are ” invited to join”. In the beginning the Druid Hills Property Owners Association known as a fraudulent voluntary association. Now forcing others to join their association or suffer the consequences, a lien or worse run out of our subdivision by the constant harassment and distress.

Malfeasance wrongful conduct by public official

David Rusterholtz came on the POA board in 2015. Only certain residents refusing to pay dues, have Liens on their properties. Those less fortunate homeowners are singled out, with harassment or foreclosure proceeding done on a non-member that they got their claws into.

That non-member offered a cash settlement, was ignored by the POA preventing the homeowner from satisfying the judgment. A collection agency called Altitude Law demanded attorney fees in a new case. The amount rose to extremes, which is illegal, foreclosing on my property in a forced asset sale with a les pendens. Forcing me to pay or lose my property. I wrote on my Business DHHOA check memo NON_MEMBER FORCED TO PAY! The law firm refused those checks, the attorney Steven Bailey refused my check to satisfy the judgment to pay attorney fees from my first case.

A good attorney named Mark Francis came to my rescue. This was the best I could hope for in my situation. He saved my property from a forced asset sale. Saving me from Judge Sells to review this new case in December by Altitude Law.

Others that do not pay assessments have no Lien-why is that? David Rusterholtz does not recognize any wrongdoing with the POA. Yet he continues to make matters worse by indoctrinating documents. That rule us and take away our rights as homeowners.  Secret meeting, forcing their standards on us as law. Rusterholtz actions were the same with the school board. In the Courier, the lawsuits commenced. Rusterholtz, became the “former president” and his name was left out in the Courier. The judge ruled no more secret meetings from the school board.

Rusterholtz is still on the school board according to the Courier after the lawsuits were resolved. In my opinion he was a cowered hiding from the law.

Definition of a cowered:To shrink away or crouch especially for shelter from something that menaces, domineers, or dismays.

A problem arises in the Druid Hills Subdivision, 49 homeowners have moved out within three years raising our property assessment valuation immensely.
